Data Protection

Privacy Policy

1) Introduction and Contact Information for the Data Controller

1.1 We are pleased that you are visiting our website and thank you for your interest. Below, we provide information about how we handle your personal data when you use our website. Personal data refers to any data that can be used to personally identify you.

1.2 The data controller for this website, as defined by the Swiss Data Protection Act (DSG), is Wolly Erwin Fritz KG, Ermsstraße 3, 72555 Metzingen (Württemberg), Germany, Tel.: 07123 9220 0, Email: info@erwin-fritz.de. The controller is the natural or legal person who, alone or jointly with others, determines the purposes and means of the processing of personal data.

2) Data Collection When You Visit Our Website

2.1 When you use our website for informational purposes only—that is, if you do not register or otherwise provide us with information—we collect only the data that your browser transmits to our server (so-called “server log files”). When you visit our website, we collect the following data, which is technically necessary for us to display the website to you:

  • The website we visited
  • Date and time of access
  • Amount of data sent in bytes
  • Source/link from which you arrived at this page
  • Browser Used
  • Operating System Used
  • IP address used (if applicable: in anonymized form)

The data will not be disclosed or used for any other purpose. However, we reserve the right to review the server log files at a later date if there are specific indications of unlawful use.

2.2 For security reasons and to protect the transmission of personal data and other confidential information (e.g., orders or inquiries to the data controller), this website uses SSL or TLS encryption. You can recognize an encrypted connection by the “https://” prefix and the padlock icon in your browser’s address bar.

3) Hosting & Content-Delivery-Network

To host our website and display its content, we use a provider that delivers its services—either directly or through selected subcontractors—exclusively on servers located within the European Union.

All data collected on our website is processed on these servers.

We have entered into a data processing agreement with the service provider that protects the data of our website visitors and prohibits its disclosure to third parties.

4) Cookies

To make your visit to our website more enjoyable and to enable the use of certain features, we use so-called cookies on various pages. These are small text files that are stored on your device. Some of the cookies we use are deleted at the end of the browser session—that is, when you close your browser (so-called session cookies). Other cookies remain on your device and allow us or our partner companies (third-party cookies) to recognize your browser on your next visit (persistent cookies). When cookies are set, they collect and process certain user information—such as browser and location data, as well as IP addresses—to the extent applicable to each individual case. Persistent cookies are automatically deleted after a specified period, which may vary depending on the cookie.

In some cases, cookies are used to simplify the ordering process by saving settings (e.g., remembering the contents of a virtual shopping cart for a later visit to the website).

We may work with advertising partners who help us make our website more interesting for you. To this end, when you visit our website, cookies from partner companies may also be stored on your hard drive (third-party cookies). If we collaborate with the aforementioned advertising partners, you will be informed individually and separately about the use of such cookies and the scope of the information collected in each case in the paragraphs below.

Please note that you can configure your browser to notify you when cookies are set, allowing you to decide on a case-by-case basis whether to accept them, or to block cookies in specific cases or generally. Each browser manages cookie settings differently. This is described in each browser’s Help menu, which explains how to change your cookie settings. You can find these for the respective browsers at the following links:

5) Making Contact

When you contact us (e.g., via the contact form or by email), personal data is collected. The specific data collected when using the contact form is indicated on the form itself. This data is stored and used exclusively for the purpose of responding to your inquiry or for establishing contact and the associated technical administration. Your data will be deleted once your inquiry has been fully processed. This occurs when the circumstances indicate that the matter in question has been conclusively resolved and provided that no statutory retention requirements preclude such deletion.

6) Data Processing When Opening a Customer Account and for Contract Fulfilment

Personal data is collected and processed when you provide it to us for the purpose of fulfilling a contract or when opening a customer account. The specific data collected is indicated on the respective input forms. You may delete your customer account at any time by sending a message to our address. We store and use the data you provide for the purpose of fulfilling the contract. After your customer account is deleted, your data will be blocked in accordance with retention periods under tax and commercial law and deleted upon the expiration of these periods, unless we can demonstrate an overriding interest in further processing within the meaning of Art. 31(2) of the Data Protection Act (DSG) or a legal justification.

7) Comment feature

When you use the comment feature on this website, in addition to your comment, information regarding the time the comment was posted and the username you selected will be stored and published on the website. Furthermore, your IP address will be logged and stored. This IP address is stored for security reasons and in the event that the individual in question infringes the rights of third parties through a posted comment or publishes unlawful content. We need your email address to contact you in the event that a third party reports your published content as unlawful. We reserve the right to delete comments if they are reported as unlawful by third parties.

8) Use of Your Data for Direct Marketing

8.1 Sign Up for Our Email Newsletter

By providing your personal information, you agree that we may use this information to send you newsletters.

We store your IP address, as provided by your Internet Service Provider (ISP), as well as the date and time of your registration, so that we can trace any potential misuse of your email address at a later date. The data we collect when you sign up for the newsletter is used exclusively for the purpose of sending you promotional communications via the newsletter. You can unsubscribe from the newsletter at any time by clicking the link provided in the newsletter or by sending us a message to that effect. Once you have unsubscribed, your email address will be immediately deleted from our newsletter distribution list, unless we can demonstrate an overriding interest in further processing within the meaning of Art. 31(2) of the Data Protection Act (DSG) or a legal justification.

8.2 Brevo

Our email newsletters are sent through this provider: Sendinblue GmbH, Köpenicker Str. 126, 10179 Berlin, Germany

Based on our legitimate interest in effective and user-friendly newsletter marketing, we share the data you provide when you subscribe to the newsletter with this provider so that it can handle the distribution of the newsletter on our behalf.

Subject to your express consent, the provider also conducts a statistical analysis of the success of newsletter campaigns using web beacons or tracking pixels in the emails sent, which can measure open rates and specific interactions with the newsletter’s content. In doing so, device information (e.g., time of access, IP address, browser type, and operating system) is also collected and analyzed, but is not combined with other data sets.
You may revoke your consent to newsletter tracking at any time with future effect.

We have entered into a data processing agreement with the provider that protects the data of our website visitors and prohibits its disclosure to third parties.

9) Data Processing for Order Fulfillment

9.1 The personal data we collect is shared with the shipping company responsible for delivery as part of the order fulfillment process, to the extent necessary to deliver the goods. We share your payment information with the designated financial institution as part of the payment processing, to the extent necessary to process the payment. If specific service providers are used for order fulfillment, we will explicitly inform you of this below.

9.2 Use of Payment Service Providers (Payment Services)

– Paypal
When paying via PayPal, credit card via PayPal, direct debit via PayPal, or—if offered—“Purchase on Account” or “Installment Payment” via PayPal, we will forward your payment information to PayPal (Europe) S.a.r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter “PayPal”). This transfer occurs only to the extent necessary for payment processing.
PayPal reserves the right to conduct a credit check for the payment methods credit card via PayPal, direct debit via PayPal, or—if offered—“purchase on account” or “installment payment” via PayPal. For this purpose, your payment data may be disclosed to credit bureaus based on PayPal’s legitimate interest in determining your creditworthiness. PayPal uses the result of the credit check—specifically, the statistical probability of default—to decide whether to make the respective payment method available. The credit report may contain probability values (so-called “score” values). To the extent that score values are included in the credit report’s results, they are based on a scientifically recognized mathematical-statistical method. The calculation of the score values takes into account, among other things but not exclusively, address data. For further information regarding data protection, including details on the credit bureaus used, please refer to PayPal’s Privacy Policy: https://www.paypal.com/de/webapps/mpp/ua/privacy-full
You may object to this processing of your data at any time by sending a message to PayPal. However, PayPal may still be entitled to process your personal data if this is necessary for the contractual processing of payments.
– TWINT
If you choose a payment method offered by the payment service provider “TWINT,” payment processing will be handled by the payment service provider TWINT AG (Stauffacherstrasse 31, CH-8004 Zurich, hereinafter “TWINT”), to whom we will forward the information you provided during the ordering process, along with the details of your order (name, address, account number, bank routing number, credit card number if applicable, invoice amount, currency, and transaction number). Your data is disclosed exclusively for the purpose of processing the payment with the payment service provider TWINT and only to the extent necessary for this purpose.

10) Use of Social Media: Social Plugins

10.1 Facebook-Plugins

Our website uses so-called social plugins (“plugins”) from the social network Facebook, which is operated by Meta Platforms Ireland Limited, 4 Grand Canal Quay, Square, Dublin 2, Ireland (“Facebook”). The plugins are identified by a Facebook logo or the label “Facebook Social Plugin.” You can find an overview of the Facebook plugins and their appearance here: https://developers.facebook.com/docs/plugins

When you visit a page on our website that contains such a plugin, your browser establishes a direct connection to Facebook’s servers. The plugin’s content is transmitted directly from Facebook to your browser and integrated into the page. Through this integration, Facebook receives the information that your browser has accessed the corresponding page on our website, even if you do not have a Facebook profile or are not currently logged in to Facebook. This information (including your IP address) is transmitted directly from your browser to a server operated by Meta Platforms Inc. in the United States and stored there.

If you are logged into Facebook, Facebook can directly associate your visit to our website with your Facebook profile. If you interact with the plugins—for example, by clicking the “Like” button or posting a comment—this information is also transmitted directly to a Facebook server and stored there. The information is also published on your Facebook profile and displayed to your Facebook friends.

If you do not want Facebook to directly associate the data collected through our website with your Facebook profile, you must log out of Facebook before visiting our website. You can also prevent the Facebook plugins from loading—and thus the data processing described above—in the future by using browser add-ons, such as the script blocker “NoScript.” (http://noscript.net/).

For information on the purpose and scope of data collection, as well as Facebook’s further processing and use of the data, and your related rights and privacy settings, please refer to Facebook’s privacy policy:
http://www.facebook.com/policy.php

10.2 Instagram-Plugins

Our website uses so-called social plugins (“plugins”) from the online service Instagram, which is operated by Meta Platforms Ireland Limited, 4 Grand Canal Quay, Square, Dublin 2, Ireland (“Instagram”). The plugins are marked with an Instagram logo, such as an “Instagram camera.” You can find an overview of the Instagram plugins and what they look like here: http://blog.instagram.com/post/36222022872/introducing-instagram-badges.

When you visit a page on our website that contains such a plugin, your browser establishes a direct connection to Instagram’s servers. The plugin’s content is transmitted directly from Instagram to your browser and integrated into the page. Through this integration, Instagram receives the information that your browser has accessed the corresponding page on our website, even if you do not have an Instagram profile or are not currently logged in to Instagram. This information (including your IP address) is transmitted directly from your browser to a server operated by Meta Platforms Inc. in the United States and stored there.

If you are logged into Instagram, Instagram can immediately associate your visit to our website with your Instagram account. If you interact with the plugins—for example, by clicking the “Instagram Camera” button—this information is also transmitted directly to an Instagram server and stored there. The information is also published on your Instagram account and displayed there to your contacts.

For information on the purpose and scope of data collection, as well as Instagram’s further processing and use of the data, and your related rights and privacy settings, please refer to Instagram’s privacy policy: https://help.instagram.com/155833707900388/

10.3 Xing-Plugins

This website uses the “XING Share Button.” When you visit this website, your browser briefly establishes a connection to XING AG’s (“XING”) servers, which provide the “XING Share Button” functions (in particular, the calculation and display of the counter value). XING does not store any of your personal data when you visit this website. In particular, XING does not store IP addresses. Nor is your usage behavior analyzed through the use of cookies in connection with the “XING Share Button.” You can access the current privacy policy for the “XING Share Button” and additional information on this website: https://www.xing.com/app/share?op=data_protection

11) Tools and Miscellaneous

Cookie-Consent-Tool

This website uses a so-called “cookie consent tool” to obtain valid user consent for cookies and cookie-based applications that require consent. The “cookie consent tool” is displayed to users when they visit the site in the form of an interactive user interface, where they can grant consent for specific cookies and/or cookie-based applications by checking the appropriate boxes. When the tool is used, all cookies and services requiring consent are loaded only if the respective user grants the corresponding consent by checking the boxes. This ensures that such cookies are set on the user’s device only if consent has been granted.
The tool sets technically necessary cookies to save your cookie preferences. Personal user data is generally not processed in this process.
If, in individual cases, personal data (such as an IP address) is processed for the purpose of storing, assigning, or logging cookie settings, this processing is based on our legitimate interest in ensuring that our cookie consent management is legally compliant, user-specific, and user-friendly, and thus in ensuring that our website is designed in compliance with the law.
Furthermore, as the data controller, we are legally obligated to make the use of non-technically necessary cookies contingent upon the user’s consent.
You can find more information about the operator and the settings options for the cookie consent tool directly in the corresponding user interface on our website.

12) Rights of the Data Subject

Under applicable data protection law, you have the following rights as a data subject (rights of access and intervention) with respect to the controller regarding the processing of your personal data; please refer to the cited legal basis for the respective conditions for exercising these rights:

  • Right of Access under Art. 25 of the DSG
  • Right to Data Disclosure or Transfer Pursuant to Art. 28 of the DSG
  • Right to rectification pursuant to Art. 32(1) of the DSG

13) Retention Period for Personal Data

The length of time personal data is retained is determined by the applicable legal basis, the purpose of processing, and—where applicable—the applicable statutory retention period (e.g., retention periods under the Law of Obligations).

When processing personal data based on explicit consent, the data in question will be retained until you revoke your consent.

If there are statutory retention periods for data, that data will be retained for the period specified by law.

Furthermore, personal data will be processed for as long as you do not expressly object to such processing, unless we can demonstrate an overriding interest in continuing the processing within the meaning of Article 31(2) of the DSG or a legal justification.
